By accessing and using Sam IT Park Website (www.samitpark.com) or by downloading materials from Sam IT Park website or using any of the Services we offer, You agree to abide by the terms and conditions of use detailed below. If you do not agree to be bound by these terms and conditions of use, Please refrain from using Sam IT Park Website or our Service.
General Terms:
Sam IT Park is an IT Service Company, registered and based in Bangladesh and the Project execution Web Development & Hosting Service of all the projects we undertake will be taken place at our development and hosting centers in Bogura, Bangladesh. Our Working hours are from 10 AM to 6 PM (10:00 Am to 18:00 Pm) GMT, from Saturday to Thursday (Close on Friday). Every Friday will be off for the company. All Public holidays in Bangladesh will also be holidays for the company.
Our Responsibilities:
Sam IT Park Company agrees to furnish Services, which are paid for, to the customer, Subject to Complete Compliance. Networks reserves the right to refuse any potential Customer at the sole discretion of Sam IT Park, Website. The failure by a customer to meet or follow, any of the policies/terms is grounds for account deactivation. Sam IT Park reserves the right to remove any account without prior notice.
Intellectual Property:
All rights related to the site design, text, graphics and other content, the selection and arrangements are licensed to Sam IT Park. The content of this website is protected by international copyright laws and other intellectual property rights. All company name and logos mentioned in the website are the trademarks, service-marks or trading names of their respective owners, including us. You may not modify, copy, upload, post by any means or in any manner, any material or information on the website or downloaded from this website including but not limited to text, graphics, video, messages, code/or software without our prior written consent, where expressly invited to do so.
Sam IT Park respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please contact us by e-mail at info@samitpark.com
Refunds:
Only all hosting services rendered by Sam IT Park network are eligible for a limited refund. Refund covers the hosting & software solution service plan itself, and does not include any other service such as SSL certificate, domain registration etc. Refund are only offered within 25-days of account registration, and only applies to the first service of a new client . Additional orders are not eligible for a refund. For example, if you’ve had an account with us before, cancelled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund. Violations of this Agreement will waive your rights under the refund policy.
Suspension:
If any violation of these rules will occur Sam IT Park reserves a right to suspend a violating account. You, as an administrator, will have permission to reactivate your client account. After the account will be reactivated you or your clients will have 12 hours to resolve the incident. If the incident will not be resolved in 12 hours, offer you a reactivated account or any violation will occur in future by the same account, Sam IT Park reserves a right to terminate the violating account and disable client profile. Root User will always be safe from any violated action caused by their end user.
Fraud:
In the event fraud is discovered, the fraudulent customer is subject to immediate suspension/termination at the sole discretion of Sam IT Park Networks. All information available to Sam IT Park networks about the fraudulent account will be submitted to both local authorities, as well any financial institutions involved. All fraud orders are investigated, and all fraud orders are investigated, and all fraudulent customers will be prosecuted to the fullest extent of the law, whether it is within the United States, or abroad.
Laws For New Accounts
We will set up your account once we receive your payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. Please provide an email address that is not from the domain you are signing up under. If there is an issue or we need to contact you, we will use the primary email address you provided. Make sure this email address is always current and up to date.
If you have a domain name registered with SAM IT PARK, you must make sure the contact information for your domain account and domain name(s) is accurate and current. SAM IT PARK is not responsible if your registration lapses due to outdated contact information. To verify or update this information, log in to your client area and make the changes yourself. Providing false contact information can result in your account being terminated.
When you purchase any service from SAM IT PARK, you must provide government-issued identification (Passport, National ID, Driving License, etc.) and proof of address (Utility Bill) within 3 days of setting up your account. This rule has been in place since April 12, 2010. If you do not meet these requirements, your order may be considered fraudulent and could be denied.
Sometimes, unforeseen issues with mail servers or connection problems between your ISP and SAM IT PARK’s operation office may delay the new account setup process.
Payment Verification:
Customers agree to potentially having to submit to fraud checking measures, designed for both the security of the customer as well as the security of Sam IT Park Networks. The fraud checks require a scan copy of Credit Card Authorization From by Sam IT Park networks, a front side screenshot of the credit card used as payment, as well as a valid scan copy of recent photo ID. We may ask for payment Verification if payment made from unverified PayPal accounts, we may ask for verification documents as well.
Disputes and Chargebacks:
The customer acknowledges that any attempt to dispute or initiate a chargeback with PayPal or their Credit Card issuer will result in a suspension of all services and a fine of $100 will be assessed to the Customer account. A chargeback imposed under false pretences is considered fraudulent and will be treated as such.
Support:
Sam IT Park network Provides hardware support related to customers server functioning. Sam IT Park network only guarantees the default installation of any software. This hosting company network is not responsible for any data loss associated with mis-configuration of scripts. Sam IT Park may provide enhanced site development support for an additional fee. Please ask sales or billing for enhanced site build-up support pricing. Hosting and software development customers may request for new php extensions or features on support tickets. Sam IT Park network does not provide any type of support to the third party customers. We will only provide support directly to customers of Sam IT Park networks.
Transfer/ Migration:
Our transfer team will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format which may make it extremely difficult if not impossible to migrate some or all account data.
IP Blacklists:
If any Customer or any third party user that is a Customer uses Sam IT Park networks services, network, or its physical information in a manner that causes Sam IT Park Networks, or any IP issued by Sam IT Park network to be blacklisted or blocked, Sam IT Park networks reserves the right to suspend or terminate services of such customer and/or its physical information. Operating Sam IT Park networks service on behalf of, or in connection with or reselling any service to persons or firms listed in the Spamhaus register of known spam Operations database at www.spamhaus.org shall constitute a violation of this AUP.
Security:
Users are prohibited from violating or attempting to violate the security of the Sam IT Park Violations of systems, network security may result in civil or criminal liability. Sam IT Park investigates occurrences, which may involve cooperation with law enforcement authorities. We are committed to respect your online privacy and recognize your need for appropriate protection and management of any personally identifiable information you share with us. Sam IT Park focuses on continual improvement of its Security.
Governing Law:
Use Of this website and any dispute arising out of its use are subject to the laws of Bangladesh. Any legal action proceeding related to or arising out of this terms & condition shall be settled in the courts or tribunals in Bangladesh.
